Texas Motorcycle Injury Litigation
An enjoyable driving experience with certain risks
The majority of motorcycle accidents are not the fault of the motorcycle rider, but of the other driver. No matter how careful we are when we ride, many of us—including our family, our loved ones and friends— are involved in wrecks resulting in serious injury or death. We have heard the excuses:
- I just did not see you
- I saw your light but thought it was a sun spot
- I just did not realize how close I was to you
We do not want excuses. We want respect on the road. And when we are injured, we expect full money damages from the at-fault driver.
Texas motorcycle helmet laws
Young motorcycle riders
For those under 21, a helmet is required while riding a motorcycle in Texas. For more specifics see Texas Transportation Code § 661.003.
Motorcycle riders over 21
Use of a helmet has been optional since 1997 for Texas motorcycle riders age 21 and over who meet certain requirements. As of September 1, 2009 the no-helmet sticker program is no longer available. The National Highway Transportation Safety Administration (NHTSA) says that in the year after the helmet law was repealed:
- Texas motorcycle helmet use dropped from 97% to 66%
- Texas motorcycle accident fatalities rose 31%
